By accessing our website or engaging with Wellstead Home Care Services, you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services or website.

Wellstead Home Care Services provides non-medical in-home care services including personal care, companion care, respite care, in-facility care, specialized care, and end-of-life care. Our services are performed by trained caregivers in accordance with applicable Texas state regulations. We do not provide medical diagnosis, nursing care, or any service that requires a licensed medical professional unless such services are explicitly arranged and documented in a separate agreement.

As a client or family representative, you agree to: • Provide accurate and complete information about the care recipient's health, needs, and home environment. • Communicate any changes in the care recipient's medical or personal situation promptly. • Treat caregivers with respect and dignity. • Ensure a safe working environment for caregivers, free from hazardous conditions. • Pay all agreed-upon fees in a timely manner per the service agreement.

Before services begin, a formal care agreement and personalized service plan will be established between Wellstead and the client or authorized representative. This agreement outlines the scope of care, schedule, rates, and expectations for both parties. Any modifications to the care plan must be communicated to and approved by a Wellstead care coordinator. Services outside the agreed plan may require additional authorization.

Payment terms are outlined in your individual service agreement. By engaging our services, you agree to pay all fees as described. Wellstead reserves the right to update its service rates with advance notice. Failure to pay outstanding balances may result in suspension or termination of services. Wellstead is not responsible for costs incurred due to discontinued care resulting from non-payment.

While Wellstead strives to provide consistent caregiver assignments, we reserve the right to reassign or substitute caregivers as necessary due to illness, scheduling conflicts, or other operational needs. We will notify clients of any changes as promptly as possible. Clients may not independently hire, engage, or contract any Wellstead caregiver outside of the agency relationship during the term of service and for a period of twelve (12) months following termination of services.

Either party may terminate services with reasonable written or verbal notice as specified in the service agreement. In cases involving safety concerns, illegal activity, or abusive behavior toward staff, Wellstead reserves the right to terminate services immediately without notice. Upon termination, any outstanding payments become immediately due.

Wellstead Home Care Services shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of our services. Our total liability for any claim arising from services rendered shall not exceed the total amount paid for services in the thirty (30) days preceding the claim. We are not liable for circumstances beyond our reasonable control, including natural disasters, emergencies, or acts of government.
